DMCA Notice & Takedown Policy
Scent Chronicles respects intellectual property rights and complies fully with the U.S. Digital Millennium Copyright Act (DMCA) and the equivalent legislation in the United Kingdom, European Union, and other jurisdictions. This page explains how copyright holders can request the removal of infringing content, and how we handle such requests.
If you believe your copyright has been infringed
Scent Chronicles publishes editorial fragrance content with a focus on original commentary, skin-tested reviews, and retail-perspective analysis. Where we reference brand materials (product photographs, official notes lists, advertising language), we do so under fair use principles for the purpose of editorial review and commentary.
If you are a copyright holder or an authorised representative of a copyright holder, and you believe that material on scentchronicles.com infringes your copyright, you may request removal by sending a properly formatted DMCA takedown notice to the contact below.
How to file a DMCA notice
To file a DMCA takedown notice, send an email to contact@scentchronicles.com with the subject line “DMCA Takedown Request”. To be considered valid under 17 U.S.C. Section 512(c)(3), your notice must include all of the following:
- A physical or electronic signature of the copyright owner or authorised representative.
- Identification of the copyrighted work claimed to have been infringed (or, if multiple works are involved, a representative list).
- Identification of the material that is claimed to be infringing, with sufficient detail (URL, post title, paragraph reference) to allow us to locate it.
- Your contact information including a valid email address, postal address, and telephone number.
- A statement that you have a good faith belief that the use of the material is not authorised by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in the notification is accurate, and that you are the copyright owner or authorised to act on behalf of the owner of an exclusive right that is allegedly infringed.
Our response process
Once a properly formatted DMCA notice is received, we will acknowledge receipt within five business days and begin our review. If the claim is clearly valid, we will remove or disable access to the allegedly infringing material as soon as practical, typically within ten business days. We will notify the original poster of the takedown and the basis for it.
If the claim is ambiguous or the material in question appears to fall under fair use for commentary, criticism, or news reporting, we may seek clarification before removing it. In all cases, we err on the side of compliance , material that is the subject of an active DMCA dispute will typically be removed pending resolution rather than remaining live during the review.
Counter-notification
If you are the original publisher of material that has been removed under a DMCA notice, and you believe in good faith that the material was misidentified as infringing or that the takedown was mistaken, you may file a counter-notification by emailing the same address with the subject line “DMCA Counter-Notification”. Counter-notifications must include all elements specified under 17 U.S.C. Section 512(g)(3), including a statement made under penalty of perjury that you have a good faith belief the material was removed as a result of mistake or misidentification.
Repeat infringer policy
Scent Chronicles maintains a repeat infringer policy in accordance with the DMCA. Authors or contributors who are determined to have repeatedly infringed copyrights of others will have their access to the publication terminated.
Misrepresentation
Please note that under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material is infringing or was removed by mistake may be subject to liability for damages, including costs and attorney fees, incurred by the alleged infringer or the service provider. Please do not submit a takedown notice unless you have a good faith belief that the material in question is genuinely infringing.
